For our part, the Coalition has always taken a hard line against family violence – the legislative reforms introduced by the former Coalition Government in 2006 reflected that stance. These legislative reforms were based on the central principle that the best interests of the child should be paramount in all family law matters.

Indeed, a recent report conducted by the Australian Institute for Family Studies found that the Coalition’s reforms were widely supported and working well.

While the Coalition is open to proposals that improve the family law system, we believe the reforms proposed in the Gillard Government’s Bill make some undesirable changes to the ‘shared parenting’ system, particularly in respect of the definition, evidentiary requirements and consequences of allegations of family violence.

The Coalition is concerned that some of the proposals in the Bill will weaken the evidentiary test for violence and may have unintended consequences when false or vexatious allegations of violence are made. These consequences would primarily be borne by the children involved.

The Coalition has proposed amendments to the Bill, in particular, to the evidentiary test provisions, which were opposed in the House of Representatives. We are disappointed that the Gillard Government voted against the Coalition’s amendments and consequently, we will be opposing the Bill.

The Coalition is determined to get the balance right when it comes to family law reform and we remain committed to prioritising the best interests of children in all family law matters.
